{"id":132008,"date":"2018-03-11T21:40:19","date_gmt":"2018-03-11T18:40:19","guid":{"rendered":"http:\/\/indrumari-juridice.eu\/indrumarijuridice\/?page_id=132008"},"modified":"2018-03-11T21:40:19","modified_gmt":"2018-03-11T18:40:19","slug":"telemunca-lege-act-normativ-avocat-cuculis","status":"publish","type":"page","link":"https:\/\/indrumari-juridice.eu\/indrumarijuridice\/telemunca-lege-act-normativ-avocat-cuculis\/","title":{"rendered":"Telemunca Lege Act Normativ-Avocat Cuculis"},"content":{"rendered":"<h2 style=\"text-align: center;\">PARLAMENTUL ROM\u00c2NIEI<br \/>\nCAMERA DEPUTA\u0162ILOR SENATUL<br \/>\nL E G E<br \/>\nprivind reglementarea activit\u0103\u0163ii de telemunc\u0103<br \/>\nParlamentul Rom\u00e2niei adopt\u0103 prezenta lege.<\/h2>\n<p>Art. 1. \u2013 (1) Prezenta lege reglementeaz\u0103 modalitatea de<br \/>\ndesf\u0103\u015furare a activit\u0103\u0163ii de c\u0103tre salariat \u00een regim de telemunc\u0103.<br \/>\n(2) Prezenta lege se aplic\u0103 \u00een domeniile de activitate \u00een care este<br \/>\nposibil\u0103 desf\u0103\u015furarea activit\u0103\u0163ii \u00een regim de telemunc\u0103.<br \/>\nArt. 2. \u2013 \u00cen sensul prezentei legi, termenii \u015fi expresiile de mai jos<br \/>\nau urm\u0103toarele semnifica\u0163ii:<br \/>\na) telemunca \u2013 forma de organizare a muncii prin care salariatul, \u00een<br \/>\nmod regulat \u015fi voluntar, \u00ee\u015fi \u00eendepline\u015fte atribu\u0163iile specifice func\u0163iei,<br \/>\nocupa\u0163iei sau meseriei pe care o de\u0163ine, \u00een alt loc dec\u00e2t locul de munc\u0103<br \/>\norganizat de angajator, cel pu\u0163in o zi pe lun\u0103, folosind tehnologia informa\u0163iei<br \/>\n\u015fi comunica\u0163iilor;<br \/>\nb) telesalariat \u2013 orice salariat care desf\u0103\u015foar\u0103 activitatea \u00een<br \/>\ncondi\u0163iile prev\u0103zute la lit. a).<br \/>\nArt. 3. \u2013 (1) Activitatea de telemunc\u0103 se bazeaz\u0103 pe acordul de<br \/>\nvoin\u0163\u0103 a p\u0103r\u0163ilor \u015fi se prevede \u00een mod expres \u00een contractul individual de<br \/>\nmunc\u0103 odat\u0103 cu \u00eencheierea acestuia pentru personalul nou angajat sau prin act<br \/>\nadi\u0163ional la contractul individual de munc\u0103 existent.<br \/>\n(2) Refuzul salariatului de a consim\u0163i la prestarea activit\u0103\u0163ii \u00een regim<br \/>\nde telemunc\u0103 nu poate constitui motiv de modificare unilateral\u0103 a<br \/>\n2<br \/>\ncontractului individual de munc\u0103 \u015fi nu poate constitui motiv de sanc\u0163ionare<br \/>\ndisciplinar\u0103 a acestuia.<br \/>\nArt. 4. \u2013 (1) \u00cen vederea \u00eendeplinirii atribu\u0163iilor ce le revin,<br \/>\ntelesalaria\u0163ii organizeaz\u0103 programul de lucru de comun acord cu angajatorul,<br \/>\n\u00een conformitate cu prevederile contractului individual de munc\u0103,<br \/>\nregulamentului intern \u015fi\/sau contractului colectiv de munc\u0103 aplicabil, \u00een<br \/>\ncondi\u0163iile legii.<br \/>\n(2) La solicitarea angajatorului \u015fi cu acordul \u00een scris al<br \/>\ntelesalariatului cu norm\u0103 \u00eentreag\u0103, acesta poate efectua munc\u0103 suplimentar\u0103.<br \/>\n(3) Angajatorul este \u00een drept s\u0103 verifice activitatea telesalariatului,<br \/>\n\u00een condi\u0163iile stabilite prin contractul individual de munc\u0103, regulamentul intern<br \/>\n\u015fi\/sau contractul colectiv de munc\u0103 aplicabil, \u00een condi\u0163iile legii.<br \/>\nArt. 5. \u2013 (1) Contractul individual de munc\u0103 se \u00eencheie \u015fi se<br \/>\nmodific\u0103, dup\u0103 caz, pentru salaria\u0163ii care desf\u0103\u015foar\u0103 activitatea de telemunc\u0103,<br \/>\n\u00een condi\u0163iile prev\u0103zute de Legea nr. 53\/2003 \u2013 Codul muncii, republicat\u0103, cu<br \/>\nmodific\u0103rile \u015fi complet\u0103rile ulterioare.<br \/>\n(2) \u00cen cazul activit\u0103\u0163ii de telemunc\u0103, contractul individual de munc\u0103<br \/>\ncon\u0163ine, \u00een afara elementelor prev\u0103zute la art. 17 alin. (3) din Legea<br \/>\nnr. 53\/2003, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare,<br \/>\nurm\u0103toarele:<br \/>\na) precizarea expres\u0103 c\u0103 salariatul lucreaz\u0103 \u00een regim de<br \/>\ntelemunc\u0103;<br \/>\nb) perioada \u015fi\/sau zilele \u00een care telesalariatul \u00ee\u015fi desf\u0103\u015foar\u0103<br \/>\nactivitatea la un loc de munc\u0103 organizat de angajator;<br \/>\nc) locul\/locurile desf\u0103\u015fur\u0103rii activit\u0103\u0163ii de telemunc\u0103, convenite de<br \/>\np\u0103r\u0163i;<br \/>\nd) programul \u00een cadrul c\u0103ruia angajatorul este \u00een drept s\u0103 verifice<br \/>\nactivitatea telesalariatului \u015fi modalitatea concret\u0103 de realizare a controlului;<br \/>\ne) modalitatea de eviden\u0163iere a orelor de munc\u0103 prestate de<br \/>\ntelesalariat;<br \/>\nf) responsabilit\u0103\u0163ile p\u0103r\u0163ilor convenite \u00een func\u0163ie de locul\/locurile<br \/>\ndesf\u0103\u015fur\u0103rii activit\u0103\u0163ii de telemunc\u0103, inclusiv responsabilit\u0103\u0163ile din domeniul<br \/>\nsecurit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103 \u00een conformitate cu prevederile art. 7 \u015fi 8;<br \/>\ng) obliga\u0163ia angajatorului de a asigura transportul la \u015fi de la locul<br \/>\ndesf\u0103\u015fur\u0103rii activit\u0103\u0163ii de telemunc\u0103 a materialelor pe care telesalariatul le<br \/>\nutilizeaz\u0103 \u00een activitatea sa, dup\u0103 caz;<br \/>\nh) obliga\u0163ia angajatorului de a informa telesalariatul cu privire la<br \/>\ndispozi\u0163iile din reglement\u0103rile legale, din contractul colectiv de munc\u0103<br \/>\naplicabil \u015fi\/sau regulamentul intern, \u00een materia protec\u0163iei datelor cu caracter<br \/>\npersonal, precum \u015fi obliga\u0163ia telesalariatului de a respecta aceste prevederi;<br \/>\n3<br \/>\ni) m\u0103surile pe care le ia angajatorul pentru ca telesalariatul s\u0103 nu fie<br \/>\nizolat de restul angaja\u0163ilor \u015fi care asigur\u0103 acestuia posibilitatea de a se \u00eent\u00e2lni<br \/>\ncu colegii \u00een mod regulat;<br \/>\nj) condi\u0163iile \u00een care angajatorul suport\u0103 cheltuielile aferente<br \/>\nactivit\u0103\u0163ii \u00een regim de telemunc\u0103.<br \/>\nArt. 6. \u2013 (1) Telesalariatul beneficiaz\u0103 de toate drepturile<br \/>\nrecunoscute prin lege, prin regulamentele interne \u015fi contractele colective de<br \/>\nmunc\u0103 aplicabile salaria\u0163ilor care au locul de munc\u0103 la sediul sau domiciliul<br \/>\nangajatorului.<br \/>\n(2) Prin contractele colective de munc\u0103 aplicabile \u015fi\/sau prin<br \/>\ncontractele individuale de munc\u0103 \u015fi regulamentele interne se pot stabili \u015fi alte<br \/>\ncondi\u0163ii specifice privind telemunca \u00een conformitate cu Legea nr. 53\/2003,<br \/>\nrepublicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare \u015fi cu Legea dialogului<br \/>\nsocial nr. 62\/2011, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<br \/>\nArt. 7. \u2013 Angajatorul are urm\u0103toarele obliga\u0163ii specifice privind<br \/>\nsecuritatea \u015fi s\u0103n\u0103tatea \u00een munc\u0103 a telesalariatului:<br \/>\na) s\u0103 asigure mijloacele aferente tehnologiei informa\u0163iei \u015fi<br \/>\ncomunica\u0163iilor \u015fi\/sau echipamentele de munc\u0103 sigure necesare prest\u0103rii<br \/>\nmuncii, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel;<br \/>\nb) s\u0103 instaleze, s\u0103 verifice \u015fi s\u0103 \u00eentre\u0163in\u0103 echipamentul de munc\u0103<br \/>\nnecesar, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel;<br \/>\nc) s\u0103 asigure condi\u0163ii pentru ca telesalariatul s\u0103 primeasc\u0103 o instruire<br \/>\nsuficient\u0103 \u015fi adecvat\u0103 \u00een domeniul securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103, \u00een special<br \/>\nsub form\u0103 de informa\u0163ii \u015fi instruc\u0163iuni de lucru, specifice locului de<br \/>\ndesf\u0103\u015furare a activit\u0103\u0163ii de telemunc\u0103 \u015fi utiliz\u0103rii echipamentelor cu ecran de<br \/>\nvizualizare: la angajare, la schimbarea locului de desf\u0103\u015furare a activit\u0103\u0163ii de<br \/>\ntelemunc\u0103, la introducerea unui nou echipament de munc\u0103, la introducerea<br \/>\noric\u0103rei noi proceduri de lucru.<br \/>\nArt. 8. \u2013 (1) Telesalariatul trebuie s\u0103 \u00ee\u015fi desf\u0103\u015foare activitatea, \u00een<br \/>\nconformitate cu preg\u0103tirea \u015fi instruirea sa, precum \u015fi cu instruc\u0163iunile primite<br \/>\ndin partea angajatorului, astfel \u00eenc\u00e2t s\u0103 nu expun\u0103 la pericol de accidentare<br \/>\nsau \u00eemboln\u0103vire profesional\u0103 at\u00e2t propria persoan\u0103, c\u00e2t \u015fi alte persoane care<br \/>\npot fi afectate de ac\u0163iunile sau omisiunile sale \u00een timpul procesului de munc\u0103.<br \/>\n(2) \u00cen mod deosebit, \u00een scopul realiz\u0103rii obiectivelor prev\u0103zute la<br \/>\nalin. (1), telesalariatul are urm\u0103toarele obliga\u0163ii:<br \/>\na) s\u0103 informeze angajatorul cu privire la echipamentele de munc\u0103<br \/>\nutilizate \u015fi la condi\u0163iile existente la locurile desf\u0103\u015fur\u0103rii activit\u0103\u0163ii de<br \/>\ntelemunc\u0103 \u015fi s\u0103 \u00eei permit\u0103 acestuia accesul, \u00een m\u0103sura \u00een care este posibil, \u00een<br \/>\nvederea stabilirii \u015fi realiz\u0103rii m\u0103surilor de securitate \u015fi s\u0103n\u0103tate \u00een munc\u0103,<br \/>\n4<br \/>\nnecesare conform clauzelor din contractul individual de munc\u0103 ori \u00een vederea<br \/>\ncercet\u0103rii evenimentelor;<br \/>\nb) s\u0103 nu schimbe condi\u0163iile de securitate \u015fi s\u0103n\u0103tate \u00een munc\u0103 de la<br \/>\nlocurile \u00een care desf\u0103\u015foar\u0103 activitatea de telemunc\u0103;<br \/>\nc) s\u0103 utilizeze numai echipamente de munc\u0103 care nu prezint\u0103 pericol<br \/>\npentru securitatea \u015fi s\u0103n\u0103tatea sa;<br \/>\nd) s\u0103 \u00ee\u015fi desf\u0103\u015foare activitatea cu respectarea dispozi\u0163iilor privind<br \/>\nobliga\u0163iile lucr\u0103torilor, a\u015fa cum sunt ele prev\u0103zute \u00een Legea securit\u0103\u0163ii \u015fi<br \/>\ns\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103 nr. 319\/2006, cu modific\u0103rile ulterioare, precum \u015fi \u00een<br \/>\nconformitate cu clauzele contractului individual de munc\u0103;<br \/>\ne) s\u0103 respecte regulile specifice \u015fi restric\u0163iile stabilite de c\u0103tre<br \/>\nangajator cu privire la re\u0163ele de internet folosite sau cu privire la folosirea<br \/>\nechipamentului pus la dispozi\u0163ie.<br \/>\nArt. 9. \u2013 (1) Pentru aplicarea \u015fi verificarea condi\u0163iilor de munc\u0103 ale<br \/>\ntelesalariatului, reprezentan\u0163ii organiza\u0163iilor sindicale la nivel de unitate ori<br \/>\nreprezentan\u0163ii salaria\u0163ilor, au acces la locurile de desf\u0103\u015furare a activit\u0103\u0163ii de<br \/>\ntelemunc\u0103, \u00een condi\u0163iile stipulate \u00een contractul colectiv de munc\u0103 sau<br \/>\ncontractul individual de munc\u0103, ori regulamentul intern, dup\u0103 caz.<br \/>\n(2) Pentru verificarea aplic\u0103rii \u015fi respect\u0103rii cerin\u0163elor legale din<br \/>\ndomeniul securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103 \u015fi al rela\u0163iilor de munc\u0103,<br \/>\nreprezentan\u0163ii autorit\u0103\u0163ilor competente au acces la locurile de desf\u0103\u015furare a<br \/>\nactivit\u0103\u0163ii de telemunc\u0103, \u00een condi\u0163iile stipulate \u00een Legea nr. 108\/1999 pentru<br \/>\n\u00eenfiin\u0163area \u015fi organizarea Inspec\u0163iei Muncii, republicat\u0103, cu modific\u0103rile<br \/>\nulterioare.<br \/>\n(3) \u00cen cazul \u00een care locul de desf\u0103\u015furare a activit\u0103\u0163ii telesalariatului<br \/>\neste la domiciliul acestuia, accesul prev\u0103zut la alin. (1) \u015fi (2) se acord\u0103 doar<br \/>\n\u00een urma notific\u0103rii \u00een avans a telesalariatului \u015fi sub rezerva consim\u0163\u0103m\u00e2ntului<br \/>\nacestuia.<br \/>\nArt. 10. \u2013 Prezenta lege se completeaz\u0103 cu prevederile Legii<br \/>\nnr. 53\/2003, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<br \/>\nArt. 11. \u2013 Constituie contraven\u0163ie \u015fi se sanc\u0163ioneaz\u0103 astfel,<br \/>\nurm\u0103toarele fapte:<br \/>\na) nerespectarea dispozi\u0163iilor art. 5 alin. (2) lit. a), referitoare la<br \/>\nobliga\u0163ia de a prevedea \u00een mod expres \u00een contractul individual de munc\u0103 sau<br \/>\n\u00een actul adi\u0163ional la acesta prestarea unei activit\u0103\u0163i \u00een regim de telemunc\u0103, cu<br \/>\namend\u0103 de 10.000 lei pentru fiecare persoan\u0103;<br \/>\nb) desf\u0103\u015furarea activit\u0103\u0163ii \u00een regim de telemunc\u0103 f\u0103r\u0103 respectarea<br \/>\nprevederilor art. 3 alin. (1), cu amend\u0103 de 5.000 lei;<br \/>\nc) nerespectarea prevederilor art. 4 alin. (2), cu amend\u0103 de 5.000 lei;<br \/>\n5<br \/>\nd) \u00eencheierea contractului individual de munc\u0103 f\u0103r\u0103 stipularea<br \/>\nclauzelor prev\u0103zute la art. 5 alin. (2) lit. b) \u2013 j), cu amend\u0103 de 5.000 lei;<br \/>\ne) nerespectarea prevederilor art. 7 lit. a) referitoare la obliga\u0163ia<br \/>\nangajatorului de a asigura mijloacele aferente tehnologiei informa\u0163iei \u015fi<br \/>\ncomunica\u0163iilor \u015fi\/sau echipamentele de munc\u0103 sigure necesare prest\u0103rii<br \/>\nmuncii, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel, cu amend\u0103 de<br \/>\n2.000 lei;<br \/>\nf) nerespectarea prevederilor art. 7 lit. b) referitoare la obliga\u0163ia<br \/>\nangajatorului de a instala, verifica \u015fi \u00eentre\u0163ine echipamentul de munc\u0103<br \/>\nnecesar, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel, cu amend\u0103 de<br \/>\n2.000 lei;<br \/>\ng) nerespectarea prevederilor art. 7 lit. c) referitoare la obliga\u0163ia<br \/>\nangajatorului de a asigura condi\u0163ii pentru ca telesalariatul s\u0103 primeasc\u0103 o<br \/>\ninstruire suficient\u0103 \u015fi adecvat\u0103 \u00een domeniul securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103, \u00een<br \/>\nspecial sub form\u0103 de informa\u0163ii \u015fi instruc\u0163iuni de lucru, specifice locului de<br \/>\ndesf\u0103\u015furare a activit\u0103\u0163ii de telemunc\u0103 \u015fi utiliz\u0103rii echipamentelor cu ecran de<br \/>\nvizualizare: la angajare, la schimbarea locului de desf\u0103\u015furare a activit\u0103\u0163ii de<br \/>\ntelemunc\u0103, la introducerea unui nou echipament de munc\u0103, la introducerea<br \/>\noric\u0103rei noi proceduri de lucru, cu amend\u0103 de 2.000 lei.<br \/>\nArt. 12. \u2013 (1) Constatarea contraven\u0163iilor \u015fi aplicarea sanc\u0163iunilor<br \/>\nprev\u0103zute la art. 11 se face de c\u0103tre inspectorii de munc\u0103.<br \/>\n(2) Contravenientul poate achita \u00een termen de cel mult 48 de ore de<br \/>\nla data \u00eencheierii procesului-verbal de constatare ori, dup\u0103 caz, de la data<br \/>\ncomunic\u0103rii acestuia, jum\u0103tate din cuantumul amenzilor prev\u0103zute la art. 11<br \/>\nlit. b) \u2013 g), agentul constatator f\u0103c\u00e2nd men\u0163iune despre aceast\u0103 posibilitate \u00een<br \/>\nprocesul-verbal de constatare.<br \/>\n(3) Contraven\u0163iilor prev\u0103zute la art. 11 le sunt aplicabile dispozi\u0163iile<br \/>\nOrdonan\u0163ei Guvernului nr. 2\/2001 privind regimul juridic al contraven\u0163iilor,<br \/>\naprobat\u0103 cu modific\u0103ri \u015fi complet\u0103ri prin Legea nr. 180\/2002, cu modific\u0103rile<br \/>\n\u015fi complet\u0103rile ulterioare.<br \/>\n6<br \/>\nAceast\u0103 lege a fost adoptat\u0103 de Parlamentul Rom\u00e2niei,<br \/>\ncu respectarea prevederilor art. 75 \u015fi ale art. 76 alin.
